Rubbish Collection Mayfair Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Mayfair provides waste and rubbish collection services to domestic, commercial and other customers. By booking a collection or otherwise using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing any booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation requesting or paying for the services.

Services means any waste, rubbish or bulky item collection, removal, transportation, loading, sorting, or related services provided by us.

Waste means any materials, items, rubbish, debris, recyclables or other discard intended to be removed under the Services, excluding Prohibited Waste as defined in these terms.

Prohibited Waste means hazardous, dangerous or restricted materials that we are not permitted or equipped to collect or transport, including but not limited to chemicals, solvents, asbestos, gas cylinders, clinical waste, biological waste, explosives and certain electrical items where specialist disposal is required.

Site means the premises, property or location where the Services are to be provided.

Contract means the agreement between us and the Customer for the provision of the Services, incorporating these Terms and Conditions.

2. Scope of Services

We provide waste and rubbish collection services within our operating area, including scheduled and one-off collections, household clearances, office clearances and commercial waste removals. The precise scope of the Services will be described in your booking confirmation, based on the information you provide at the time of booking.

We reserve the right to refuse or suspend Services if the Waste presented for collection differs materially in type, quantity or access requirements from the details provided in the booking. Additional charges may apply where the actual Waste or work required exceeds the agreed estimate.

3. Booking Process

3.1 Booking requests may be made by telephone or through our online enquiry channels where available. A booking is not confirmed until we have accepted it and provided a booking confirmation with the agreed date, time window, estimated price and any specific conditions.

3.2 When making a booking, you must provide accurate and complete information about:

the type and approximate volume or weight of Waste to be collected

any large or bulky items requiring special handling

access conditions, including parking restrictions, stairs, lifts, or limited entry points

any time restrictions, building requirements or site rules we must follow.

3.3 Our estimate and booking acceptance are based on the information you provide. If on arrival we find that the Waste or circumstances differ significantly, we may revise the price, adjust the scope, or decline to carry out all or part of the Services.

3.4 You are responsible for ensuring that you, or an authorised representative, is present at the Site at the agreed time to grant access, confirm items for removal and sign any documentation if required.

4. Prices and Payments

4.1 Our charges are generally based on the volume, weight, type of Waste, labour required and any additional services requested. We may provide an estimated price in advance and confirm the final price once the Waste has been inspected on site.

4.2 Unless otherwise agreed in writing, payment is due in full on completion of the Services, and must be made by an accepted payment method. We may require a deposit or full prepayment for certain bookings, larger clearances or commercial arrangements.

4.3 All prices are quoted in pounds sterling and may be subject to applicable taxes or government charges. Where VAT applies, this will be charged at the prevailing rate and clearly stated on your invoice or receipt.

4.4 If payment is not received when due, we reserve the right to charge interest on overdue amounts at a reasonable commercial rate and recover any reasonable costs incurred in chasing or recovering late payments.

4.5 For ongoing or contractual commercial waste collections, billing and payment terms may be set out separately in a service agreement, but these Terms and Conditions will still apply unless specifically varied in writing.

5. Cancellations and Amendments

5.1 You may cancel or amend a booking by contacting us as soon as possible and quoting your booking details. Cancellations or significant changes may be subject to charges, particularly where we have allocated resources or incurred costs in preparation.

5.2 Where you cancel more than 24 hours before the scheduled collection time, we will generally not charge a cancellation fee, unless otherwise stated at the time of booking or in a separate agreement.

5.3 Where you cancel within 24 hours of the scheduled collection time, fail to provide access at the agreed time, or the collection cannot proceed due to reasons within your control, we may charge a reasonable call-out or cancellation fee to cover our costs.

5.4 We may cancel or reschedule the Services at any time due to circumstances beyond our reasonable control, including severe weather, traffic disruption, vehicle breakdown, staff illness, safety concerns, or regulatory issues. In such cases, we will endeavour to notify you as soon as possible and arrange an alternative time. We will not be liable for any loss arising from such cancellations or delays, but any prepayments for unperformed Services will be refunded or credited.

6. Customer Obligations

6.1 You must ensure that the Site is safe, accessible and suitable for the provision of the Services. This includes providing adequate access for our staff and vehicles, safe routes for carrying Waste, and where applicable, suitable parking or loading space.

6.2 You must clearly identify the Waste to be removed and ensure that it does not include Prohibited Waste or items which you are not entitled to dispose of. You are responsible for ensuring that no items intended to be kept are mistakenly presented as Waste.

6.3 You must inform us in advance of any health and safety risks, structural issues, fragile areas, or special access conditions at the Site. We may refuse to provide Services if we consider the conditions unsafe.

6.4 Where our staff are required to enter buildings or private areas, you must ensure that they are accompanied if necessary, and that access complies with any building regulations, security requirements and insurance terms relevant to the property.

7. Waste Regulations and Prohibited Items

7.1 We operate in accordance with applicable UK waste management laws and regulations. Waste collected by us will be transported and disposed of or recycled at authorised facilities in line with legal requirements and good environmental practice.

7.2 We do not accept Prohibited Waste, including but not limited to:

asbestos or suspected asbestos materials

clinical or medical waste

liquids, oils, paints, solvents or chemicals

gas cylinders, fuel containers or pressurised vessels

explosives, firearms or ammunition

radioactive materials

certain electrical equipment requiring specialist treatment, unless specifically agreed in advance.

7.3 If Prohibited Waste is discovered amongst the Waste at any stage, we may:

refuse to collect the relevant items

return the items to you if already loaded, where safe to do so

charge you for any additional handling, storage, return, treatment or disposal costs we incur

notify the relevant authorities where legally required.

7.4 You warrant that the Waste presented for collection does not include any Prohibited Waste and that you are lawfully entitled to dispose of it. You agree to indemnify us against any claims, penalties, costs or liabilities arising from breach of this warranty or from any unlawful or unsafe Waste you present.

8. Performance of the Services

8.1 We will provide the Services with reasonable care and skill, using appropriately trained personnel and suitable vehicles and equipment for the work required.

8.2 Time of collection is not guaranteed, but we will use reasonable efforts to arrive within the agreed time window. We are not liable for delays caused by factors beyond our reasonable control, such as traffic conditions, road closures or adverse weather.

8.3 Our staff will use reasonable efforts to avoid damage when removing Waste, but you should take steps to protect floors, walls, doorways and other surfaces where you consider them to be at risk. We are not responsible for normal wear and tear or minor scuffs that may occur during the movement of bulky items through tight spaces.

8.4 We reserve the right to refuse to move any item if, in our reasonable opinion, doing so would endanger the health or safety of our staff, risk significant damage to the property, or breach any legal or regulatory requirement.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

9.2 Subject to the above, we shall not be liable for any indirect, special or consequential loss, or for any loss of profit, revenue, business, goodwill or anticipated savings arising out of or in connection with the Services or these Terms and Conditions.

9.3 Our total liability to you for any loss or damage arising out of or in connection with a particular booking, whether in contract, tort including negligence or otherwise, shall be limited to the total amount paid or payable by you for that booking.

9.4 We are not liable for any loss or damage arising from:

your failure to provide accurate information when making the booking

items mistakenly presented as Waste

pre-existing defects or conditions at the Site

acts or omissions of third parties not under our control

events beyond our reasonable control, including force majeure events.

9.5 You must inspect the Site promptly after completion of the Services and notify us in writing of any alleged loss or damage as soon as reasonably practicable and in any event within 7 days. We may not be able to consider complaints received outside this timeframe.

10. Insurance

We maintain appropriate insurance cover for our activities in accordance with industry practice and applicable law. Details of our insurance can be provided upon reasonable request. Your own property and contents should be covered by your own insurance arrangements, and you should check your policy and notify your insurer where relevant before booking Services.

11. Data Protection and Privacy

We will collect and process personal data in connection with your booking and the provision of Services, including your contact details, site address and payment information. We will handle such data in accordance with applicable data protection laws and use it only for legitimate business purposes such as managing bookings, processing payments, improving our services and complying with legal obligations.

By using our Services, you consent to the collection and use of your information for these purposes. You may contact us to request access to, correction of, or deletion of your personal data where legally permitted.

12. Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing full details of your concern and any supporting information. We will investigate and aim to respond within a reasonable timeframe, proposing any appropriate remedial actions or explanations.

We value feedback and will use it to improve our rubbish collection and waste removal services. Where a dispute cannot be resolved directly between us, you may be entitled to pursue legal remedies as set out under the governing law and jurisdiction section below.

13. Variations to Terms

We may revise these Terms and Conditions from time to time, for example to reflect changes in the law, industry practice or our service offering. The version in force at the time of your booking will apply to that booking. Updated terms may be made available on request or through our standard customer communication channels.

14. Severance

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the provision of our rubbish and waste collection services.

16. Entire Agreement

These Terms and Conditions, together with any written booking confirmation or service agreement, constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings, arrangements or representations, whether oral or written. You acknowledge that you have not relied on any statement or representation not expressly set out in the Contract.
